A MALAGA court is considering the case of the 27-year-old driver accused of causing an accident on the AP-7 motorway in Benalmadena in April which killed nine Finnish tourists and injured a further 41 (EWN 1190).
A Torremolinos court sent him to prison on remand without bail charged with 52 offences, including reckless driving, driving while under the influence of alcohol, negligent manslaughter and causing injury. His lawyers appealed this sentence and the case is now being reviewed by a Malaga court.
During his statement, the driver admitted to having drunk a little before driving and that he may have been driving too fast. He also said he was horrified to think about the accident he had caused.
Guardia Civil investigating the case have concluded that he was travelling at excessive speed in conditions of wind and rain and was twice over the legal alcohol limit, when he overtook another car, hit the central reservation and then swerved into the path of the bus, causing it to lose control and flip over.
