A MALAGA court has agreed with the fines imposed by the Junta de Andalucia on shops in the Northern part of the Vialia shopping centre in Malaga. The shop owners were fined for opening on Sundays and holidays as it was considered they are not under the protection of the special regime for train stations. The Northern Gallery of the centre is not actually part of the station and is in the shopping area, therefore it is seen as offering services to the general public, not just passengers.
Malaga contentious and administrative court had already issued a sentence which backed the decision of the Junta de Andalucia, based on the Commerce Law, which prevents the commercial area of the Maria Zambrano Station from opening every Sunday and all holidays.
By law, shopping centres can only open eight Sundays or holidays per year.
The centre will be fined 150,000 euros for a serious infringement, the amount then rises 20 per cent for each day that passes without meeting with legal requirements.
Vialia has already been fined 136,000 and 600,000 euros on two occasions in 2007, and the 47 shops in the Northern Gallery have also been fined. |
